Release of Liability

Read Carefully - This Affects Your Legal Rights

In exchange for participation in the activity of boxing and related activities organized by Buettner Boxing INC., of 944 IL Route 22, Fox River Grove, IL 60021 and/or use of the property, facilities, and services of Buettner Boxing INC., I, {name} of {address}, agree for myself and (if applicable) for the members of my family, to the following: 

1. Agreement To Follow Directions. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Buettner Boxing INC., or the employees, representatives, or agents of Buettner Boxing INC..

2. Assumption of the Risks and Release. I recognize that there are certain inherent risks associated with the above-described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and hold harmless Buettner Boxing INC. and its owners, officers, directors, employees, contractors, affiliates and advisors for injury, loss, death or damage arising out of my or my family's use of or presence upon the facilities of Buettner Boxing INC., whether caused by the fault of myself, my family, Buettner Boxing INC. or other third parties, whether active or passive. Buettner Boxing Inc. and its owners, officers, directors, employees, affiliates and advisors assumes no responsibility for any medical expenses, injury, or damage suffered by Participant in connection with the use of the facilities, equipment or services in connection with the boxing/fitness training class(es). My assumption of risk includes, but not limited to, injuries from training, competition, uneven or irregular surfaces, injuries from contact with equipment or from equipment failures, injuries from physical contact with other participants or injuries incurred while performing the physical activities inherent in participation in this activity. This waiver and release of liability includes, but not limited to, injuries which occur as a result of negligence from (a) use of any equipment, facilities or premises which may malfunction or break, (b) negligent maintenance of any equipment or facilities, (c) negligent instruction or supervision, and (d) slipping and falling for any reason, including negligent inspection or maintenance of the facility or premises.

3. Indemnification. I agree to indemnify and defend Buettner Boxing INC. against all claims, causes of action, damages, judgments, costs, or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Buettner Boxing INC..

4. Fees. I agree to pay for all damages to the facilities of Buettner Boxing INC. caused by any negligent, reckless, or willful actions by me or my family.

5. Applicable Law. Any legal or equitable claim that may arise from participation in the above shall be resolved under Illinois law.

6. No Duress. I agree and acknowledge that I am under no pressure or duress to sign this agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this agreement if I so desire. I further agree and acknowledge that Buettner Boxing INC. has offered to refund any fees I have paid to use its facilities if I choose not to sign this agreement.

7. Arm's Length Agreement. This agreement and each of its terms are the product of an arm's length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this agreement or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.

8. Enforceability. The invalidity or unenforceability of any provision of this agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this agreement or of any other applications of such provision, as the case may be. Such invalid or unenforceable provision shall be deemed not to be a part of this agreement. 

Photo/Video Release Acknowledgement

I, the undersigned, hereby grant permission to Buettner Boxing Inc., its owners, staff, representatives, and associates, to photograph, video record, and otherwise capture my image, likeness, voice, and participation in activities, classes, training sessions, events, or programs at Buettner Boxing.

I understand and agree that these photos and videos may be used for purposes including, but not limited to:

• Social media content
• Website and online marketing
• Promotional materials and advertisements
• Print materials (flyers, posters, brochures)
• Gym displays and presentations

I acknowledge that this media may be used without further notice to me.

I understand that I will receive no financial compensation or other payment for the use of these images or recordings.

I understand that all photos, videos, and recordings are the sole property of Buettner Boxing Inc. I waive any right to inspect or approve the finished media or its specific use.

I release and discharge Buettner Boxing Inc. and its representatives from any and all claims, demands, or causes of action that I may have related to the use of these images or recordings, including claims for libel, invasion of privacy, or violation of publicity rights.

If the participant is under 18 years of age, a parent or legal guardian must sign below.

Minors

If the participant is under the age of 18, a parent or legal guardian must sign below, granting consent on behalf of the minor.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.

This Membership Agreement is entered into between Buettner Boxing Inc. located at 944 IL Route 22 Fox River Grove, IL 60021-1918, and the undersigned member {name}.

By signing below, {name} agrees to all terms and conditions of this Agreement.

1. MEMBERSHIP TERMS

1.1 Membership Type: {membership_title}
1.2 Start Date: {start_date}
1.3 Membership Fee: {membership_fees}
1.4 Duration: {membership_duration}

Membership grants access only to the services included in the selected plan.

All contracts roll over automatically to a month-to-month term at the contracted rate unless stated otherwise.

All punch cards expire 90 days from the date of purchase or when all 10 classes have been fulfilled.

2. PAYMENT & BILLING

2.1 Payments are due in at the scheduled billing date and are non-refundable unless otherwise stated in this Agreement.

2.2 {name} authorizes Buettner Boxing Inc. to charge the payment method on file on a recurring basis.

2.3 Late payments of two or more may result in suspension of membership.

3. CANCELLATION & TERMINATION

3.1 Member Cancellation:
{name} may cancel by call, text, email or direct message at least 14 days prior to the next billing cycle.

3.2 Early Termination (Contract Memberships):
Early cancellation may result in a cancellation fee of $200 for 6-month contracts and $150 for 3-month contracts unless otherwise required by law.

3.3 Gym Termination:
Buettner Boxing Inc. may terminate this Agreement immediately for violations of gym rules, unsafe behavior, non-payment, or conduct deemed harmful to staff or members.

4. USE OF FACILITIES & RULES

4.1 {name} agrees to follow all posted gym rules and staff instructions.

4.2 Proper boxing/kickboxing equipment for participation in contact drills is required:

• Kickboxing: shin guards, mouth guard
• Intermediate boxing: mouth guard, boxing shoes
• Advanced boxing: head gear, mouth guard, cup (optional for females), boxing shoes, USA Boxing membership for insurance purposes

4.3 Buettner Boxing Inc. reserves the right to modify hours, classes, trainers, or equipment without notice.

4.4 No harassment, violence outside training, or unsafe conduct will be tolerated.

5. ASSUMPTION OF RISK

Member understands that boxing, training, sparring, and related fitness activities involve inherent risks, including but not limited to serious injury or death.

Member voluntarily assumes all risks associated with participation, whether supervised or unsupervised.

6. RELEASE & WAIVER OF LIABILITY

To the fullest extent permitted by law, Member releases and holds harmless Buettner Boxing Inc., its owners, employees, trainers, and affiliates from any claims, injuries, damages, or losses arising from participation in gym activities.

This waiver includes claims based on negligence.

7. MEDICAL REPRESENTATION

Member represents that they are physically capable of participating in boxing and related activities and have no medical conditions that would make participation unsafe.

Member agrees to consult a physician before beginning any training program.

8. MINORS (IF APPLICABLE)

If Member is under 18 years of age, this Agreement must be signed by a parent or legal guardian, who agrees to all terms on behalf of the minor.

9. PHOTOGRAPHY & MEDIA RELEASE

Member grants Buettner Boxing Inc. permission to use photographs or videos taken on the premises for promotional purposes unless Member provides written notice opting out.

10. PERSONAL PROPERTY

Buettner Boxing Inc. is not responsible for lost, stolen, or damaged personal items.

11. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Illinois.

12. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions or agreements. Any changes must be made in writing and signed by both parties.

MEMBER ACKNOWLEDGMENT

By signing, I have read, understood, and agree to all terms of this Membership Agreement.

PARENT / GUARDIAN (IF MINOR)

By signing, I have read, understood, and agree to all terms of this Membership Agreement on behalf of my minor.
